Where was I, oh yes, Mr. Orlosky told the jury that the Jeep was coming down the road at him faster than he had ever seen a vehicle travel on that road. It was going at least fifteen miles per hour, his words. His lawyer, Mr. Pfingst, said that he fired all 11 shots in 3 or 4 seconds, 165 to 200 rounds per minute. ( Since Mr, Orlosky picked up his shell casings at the scene it cannot be determined with any certainty how many shots he actually fired. He brought 11 shell casings to the court. There are 9 holes in the Jeep.) It seems that the semi automatic firing rate is more a function of one's ability to pull the trigger rather than any mechanical limit of the weapon. All of the web sites that I have visited give the semi automatic rate for the AR-15 at 45 to 90 rounds per minute. Using a different approach, I found a site on You Tube and timed a young man shooting an AR-15 with a 90 round side mounted magazine. He did shoot 11 rounds in 4 seconds, so for now I will assume that Orosky was capable of doing the same. It should be pointed out, however, that the young man was not "terrified", did not fire from the hip and then the shoulder, and did not leap to one side while shooting.
Now for a little math, the Jeep was traveling at 15 mph. which is 22 ft. per second. At 11 shots in 4 sec, you get 2.75 shots per second, or the Jeep traveled 8 ft. per shot. All of this using Mr. Orlosky's words. Mr. Orlosky said that the Jeep was perhaps 15 feet in front of him when he started shooting. The water on the road from the radiator would seem to bear that out. The first bullet hit at 15 ft., The second bullet hit at 7ft. The third bullet hit at minus 1 ft. Sometime between the second and third shots Mr. Orlosky would have had to leap out of the way to avoid being struck by the Jeep. The shooting could not possibly have happened the way Mr. Orlosky described it because there are three holes in the front of the Jeep, one in each headlight and one in the right side of the radiator, and none of them struck the vehicle straight on.
